General Terms and Conditions and Privacy Policy

for download and use of application on Mobile Devices

By accessing or downloading mobile applications or services (referred to as “Application”) provided by G O BPO Services Pvt. Ltd / Golden Opportunities Pvt. Ltd / GO Accomplish / HR Information Services / Human Capital or its partners /affiliates /vendors /Employees /Directors /Principles /associates /agents /owners /share holders /management /Various websites maintained by them / third parties who are associated with the development and delivery of various training programs / products / content/ services. etc. (herein called as “Provider”), the user (either an individual or a business entity, who is using or paying for the services or is assigned to access the site or the content, Affected Party – Any third party who through the User is directly or indirectly knowing or unknowingly is involved or associated in any way with the content/training/concepts/coding etc. of this Application or site) agree to abide by the below mentioned terms and conditions and privacy policy. Provider reserves the right to modify terms and conditions from time to time depending upon the industry and organization standards, further which the Application usage will be governed by newer version. We recommend the users to check the terms and conditions regularly. The use of Application will also be subject to the Terms and conditions and Privacy policy notified on the website. If you do not agree to the Terms and Conditions, you can refrain from accessing the Application. All texts, graphics, user interfaces, visual interfaces, photographs, logos, sound, (together considered as “content”), including but not limited to the design, structure, “look and feel” and arrangement of the content, contained on the Application is owned, controlled or licensed by Provider and are protected under copyright, patent and trademark laws and various other intellectual property rights and unfair competition laws The images for Applications are used from the collection of Microsoft Clip arts and/or other sources, which are royalty free. The User does not acquire ownership rights to any content, document or material viewed through the Application. No part of the site and content may be copied, duplicated, sold, traded, reproduced, or republished for any purpose unless the users gets specific permissions in writing from the copyright owner and submits to the provider in case the provider is not the copyright owner. All material on the Application is protected under copyright laws. As a valuable user, the Provider encourages the user to retrieve content from the site and store it for your personal, non-commercial use. However, reproduction/modification or distribution of content from the Application for commercial purposes is prohibited. Permission for usage can be obtained through a formal request to the Editorial team. Please visit the Provider website or contact our Editorial team for details. The Provider provides certain content which may be procured from a third party. The Provider does not take any responsibility for the content or advice or data provided in the application. In case the provider feels or discovers the content may violate any law, regulation, general ethics or policies the provider has a right to remove the content any time without giving any notice to the user. The provider will also remove the old content any time or display old content any time. It is a complete responsibility of the user to take or not to take any action based on the content. The user should check with the service provider for further details. The provider has duly taken efforts for the effective functioning of the Application. However the Provider not responsible for any technical problems, malfunctions of any kind including but not limited to; to telephone lines, mobile communication systems, servers, hardware / software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer or mobile transmission or any combination thereof. The User understands and agrees that any use of application and any products provided by the Provider is at user’s own discretion and risk and the user is solely responsible for any damage to your computer system, mobile device, or other device, or loss of data, loss of business, loss of health, loss of job etc. that results from such use. The Provider bears no liabilities for any damages to any computer or mobile system or device resulting from participating in or accessing or downloading information in connection with the Application. The Provider assumes no responsibility if applications are not delivered or errors occur, whether resulting from any form of active or passive mobile or network filtering by a user’s internet service provider or mobile service provider or for insufficient space in mobile. The User expressly understands and agrees that the use of application is at user’s sole risk and that is provided “as is” and “as available” without warranty of any kind, to the maximum extent permitted by applicable law. The User also understands that it is users sole responsibility to use or not to use any or full or in part of the content, information, software, advise, data etc. The Provider has no responsibility to the user or to any third party for the use and non use of the application in part or in full including but not limited to the software, data, content, website/s, information, advice etc. The Provider has no responsibility to the user or to any third party for any breach of your obligations under the Terms, and for the consequences (including loss or damage of any kind which anyone may suffer) of any such breach. The User expressly understands and agrees that Provider shall not be liable to the user or any third party under any theory or description of liability (whether contract, tort including negligence or otherwise) for any direct, indirect, incidental, special consequential or exemplary damages that may be incurred by/to user/you/third party through your use/non use of Application or any products downloaded or obtained from the provider, including any loss of data, whether or not Provider or its representatives have been advised of or should have been aware of the possibility of any such losses arising. To the maximum extent permitted by law, the user agrees to defend, indemnify and hold harmless the Provider from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys fees) arising out of or accruing from your use of the application, including users downloading, installation, or use of any content, data, software, information, advice etc. or your violation of these Terms. The User agrees not to modify the content, format or include any additional content for any promotional or commercial purpose. The content is owned by the provider. The Provider grants the user limited, non-exclusive, non-transferable, revocable rights to download and use the content on a designated device alone, solely for users own personal, non-commercial use. The User agrees not to reproduce, modify, perform, transfer, distribute, sell, create derivative works of or otherwise use or make available the content or the programs except as expressly provided for in these terms and conditions. The User cannot redistribute/share the Application across mobiles nor do multiple installations on a single phone instrument. The User also agrees that user will not do anything directly or indirectly or support any third party which damages, disrupts any application, product, servers etc provided by the Provider or any third party. The User agrees that the Provider may stop (permanently or temporarily) providing the Application or support or content to the user or to other users at Provider’s sole discretion, without prior notice to the user. The User also agrees in such a case the user may be prevented from accessing any detail on users past activities, information, data or any files etc which may be stored and retained by the Provider. The Application will/may communicate with servers from time to time to check for available content, updates to the Products, such as bug fixes, patches, enhanced functions, missing plug-ins and new versions (collectively, "Updates"). By installing this application, you agree to such automatically requested and received Updates. The User agrees to use Application only for purposes that are permitted by (a) the Terms and (b) any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions. The User agrees to comply with all applicable export controls, including, but not limited to laws of users country but also the laws of the hosting country the United States (US in few cases or any other country from where the user has downloaded the application in full or in part) and the owning company’s country India. The User also agrees and states that the user has not been prohibited from receiving exports or services under US or other applicable export laws of US, Hosting country as the case may be, India and users country. The User also agrees to comply with all local laws and regulations regarding the download, installation and/or use of the Products. These Terms constitutes the whole legal agreement between the user and the Provider and governs the use of Applications and Products, and completely replace any prior agreements between the user and Provider in relation to Provider and Products. Any delay or not enforcement of any term by the Provider cannot be constituted and waiver of Providers Rights. The Provider has a right to enforce any term in part of full at any time. In case any term is found to be invalid by Indian Law then that term will be removed and the agreement will continue as it is without that particular term or clause. The remaining provisions of these Terms will continue to be valid and enforceable. The rights granted in the Terms may not be assigned or transferred by you without the prior written approval of the Provider. These Terms and users relationship with Provider under these Terms shall be governed by the laws Republic of India without regard to its conflict of law’s provisions. The user and Provider agree to submit to the exclusive jurisdiction of the courts located within the city of Chennai, Tamil Nadu to resolve any legal matter arising from these Terms. Notwithstanding this, you agree that Provider shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction. In order to access certain services in Application, the user may be required to provide information about the user such as your name, address, Phone number, IP, Email ID and billing details etc. The user agrees that any such information provided to Provider will always be accurate, correct and up to date. When the user uses the application or the site or communicate with the application, software, data, content etc, The Provider will use the information as provided or obtained from the user in the ways a user may reasonably expect us to – for example, service delivery or improvement or customer support. Where user may not have choices about how the provider uses the information thus provided by the user. Because of the way the Application operates, the Provider may also use information from the application, browser or browsing activities or device etc to personalize the site or route the user to relevant information. For example, the provider may use web-log information, cookies or web beacons in ways that help us maintain some of user site preferences send the user to the right country-specific information or understand how our visitors navigate the application/site so the provider can make it better. Some of the services or information, data, advice, content the user accesses on this application may come from a third party. Therefore, the provider may share the user information with other companies and third parties. The User agrees that the user will and have no problem in the Provider sharing this information with any third party. The laws of the countries where these third parties are based or located may not be the same as those in the users country or the way the user has understood or the user is used to, but the user information will be treated with the same high standard of care wherever it’s processed. From time to time, Provider may need to update these terms because of a change in the Application, website’s functionality or in applicable laws etc. When the Provider does so, the provider will try to intimate the user the same through the application.
